본 발명의 개념에 따른 비휘발성 메모리 소자는 기판 상의 하부 전극, 상기 하부 전극 상의 상부 전극, 상기 하부 전극 및 상기 상부 전극 사이의 터널 배리어 패턴, 및 상기 하부 전극과 접촉하고, 상기 하부 전극을 사이에 두고 상기 터널 배리어 패턴과 이격하는 고정 전하 패턴(fixed charge layer)을 포함한다. 상기 터널 배리어 패턴은 반강유전체 물질을 포함한다 상기 하부 전극은 제1 물질을 포함한다. 상기 상부 전극은 제2 물질을 포함한다. 상기 제1 물질 및 상기 제2 물질은 서로 일 함수(work function)가 다르다.
